宣言文の第八条は「ひらいたものは、閉じない」と約束しています。このページは、その約束を法的な言葉に翻訳したものです。

The first principle of the manifest promises that what is opened does not close. This page is that promise translated into legal terms.

Status of the sources

本アーカイブが扱うのは、次のいずれかに該当する資料のみです。

This archive handles only material that falls into one of the following.

• 著作権の保護期間が満了した著作物各資料のページに、原著者の没年または初出年を明記します。
• はじめから公有とされている文書公的機関が公開した資料、パブリックドメイン宣言のなされた著作など。
• 失効した特許の明細書と図面権利期間を満了し、発明が公有に帰した特許。

• Works whose copyright term has expiredEach entry states the author's year of death or the year of first publication.
• Documents public from the outsetMaterial released by public bodies, works placed in the public domain, and the like.
• Expired patent specifications and drawingsPatents whose term has run out and whose invention has passed into the public domain.

保護期間は国によって異なります。日本では著作者の死後70年、アメリカでは1929年以前の刊行物が原則として公有ですが、例外が多数存在します。ある資料が公有であるという私たちの判断に誤りを見つけた場合は、お問い合わせからご連絡ください。確認のうえ、必要であれば速やかに取り下げます。

Terms differ by country. Japan runs 70 years from the author's death; in the United States works published before 1929 are generally public domain — with many exceptions. If you find an error in our judgement that something is public domain, please tell us. We will check and, if necessary, take it down promptly.

Terms for what we make

原典そのものは公有ですが、訳文・注釈・図面の再作図・構造化データは、私たちの手が加わった新しい成果物です。それらの扱いを次のように定めます。

The sources themselves are public domain, but translations, notes, redrawn plans and structured data are new work of ours. They are governed as follows.

宣言文の第七条は「分岐を歓迎する」と述べています。この方針を守るかぎり、ここに CC0 系または BY 系以外（商用利用禁止・改変禁止など）を選ぶことはできません。NC や ND を付けた瞬間、それは「ひらいた」ことになりません。

The seventh principle welcomes the fork. As long as that holds, nothing outside the CC0 or BY families — no non-commercial or no-derivatives clause — can be chosen here. The moment NC or ND is attached, it has not been opened.

失効特許の取り扱いについて

On expired patents

特許が失効していれば、その発明を誰が実施しても構いません。ただし、次の三点は失効によっても消えません。実装の前に必ず確認してください。

Once a patent has expired, anyone may work the invention. Three things, however, do not expire with it. Check them before you build.

1. 周辺特許元の特許が切れていても、その改良発明に有効な特許が存在することがあります。図面どおりに作るぶんには問題なくとも、改良を加えた結果が他者の権利に触れる可能性があります。
2. 商標装置名や製品名は、特許とは別に商標として生きている場合があります。設計は自由でも、その名前を使えるとは限りません。
3. 法令・規格電気工作物、圧力容器、飲用水、燃焼機器などには、特許とは無関係の法規制と安全基準があります。自作の可否は国と地域によって異なります。

1. Surrounding patentsEven when the original patent has lapsed, live patents may cover improvements on it. Building to the drawing may be clear while your own modification is not.
2. Trade marksA device or product name can remain a live trade mark independently of the patent. The design may be free; the name may not be.
3. Regulation and standardsElectrical work, pressure vessels, drinking water and combustion equipment are governed by rules and safety standards that have nothing to do with patents, and that differ by country.

また、宣言文の第四章に書いたとおり、特許が認められたという事実は、その機構が実際に動くことの保証ではありません。審査が見るのは新規性と進歩性であって、性能ではないからです。各資料の検証の段階表示を必ず確認してください。

And as chapter IV of the manifest says: the fact that a patent was granted is not a guarantee that the mechanism runs. Examination looks at novelty and inventive step, not performance. Always check the verification stage shown on each entry.

Every build from the drawings published here is undertaken at your own risk.

Mechanics が扱うのは、水・熱・電気・圧力・燃焼といった、扱いを誤れば人が死ぬ領域です。多くの設計図は翻刻または成立確認の段階——つまり、まだ誰も組んでいない段階——で公開されます。これは欠陥ではなく、そう明示したうえでの公開です。

Mechanics deals with water, heat, electricity, pressure and combustion — domains in which mistakes kill people. Many drawings are published at the transcribed or reviewed stage, meaning no one has built them yet. That is not a defect; it is published as such, in the open.

• 飲用について浄水に関する機構は、水質検査を経ずに飲用に供しないでください。
• 電気について国内では、電気工事士等の資格を要する作業があります。
• 圧力・燃焼について破裂・一酸化炭素中毒・火災のリスクを伴います。屋内での試験は避けてください。
• 構造について人の上や下に来る構造物には、必ず余裕のある安全率を取ってください。

• DrinkingDo not use water from a purification device for drinking without a water quality test.
• ElectricitySome work requires a licensed electrician in your jurisdiction.
• Pressure and combustionRisk of rupture, carbon monoxide poisoning and fire. Do not test indoors.
• StructureAnything that will sit above or below a person needs a generous safety factor.

寄稿された訳文・図面・記録は、上の表と同じ条件で公開されます。寄稿の時点で、その条件に同意したものとみなします。著作者としての表示を希望される場合は、その旨をお知らせください。匿名での寄稿も歓迎します。

Contributed translations, drawings and records are published under the same terms as above, and contributing is taken as agreement to them. If you would like to be credited by name, say so. Anonymous contributions are equally welcome.

動かなかった記録も、同じ重さで受け取ります。失敗の報告は、成功の報告と等しく、このアーカイブの中身です。

Records of failure are received with the same weight. A report that something did not work is as much the contents of this archive as a report that it did.
